Acceptable Use Policy
Effective Date: January 1, 2024
This Acceptable Use Policy (“AUP”) sets out the standards for use of First City Internet, LLC’s (“First City Internet,” “we,” “us,” or “our”) network, services, and infrastructure. By accessing or using our services, you agree to comply with this AUP in addition to our Terms of Service and any applicable service agreements.
This AUP applies to all customers, users, and any party that accesses our network directly or indirectly through our services.
1. Acceptable Use
You may use First City Internet’s services for lawful business and personal purposes consistent with your service agreement. Acceptable uses include:
- Standard business communications including email, VoIP, and video conferencing
- Access to cloud services, SaaS platforms, and internet-based applications
- Website hosting and web-based operations within the scope of your service plan
- Remote work, file sharing, and collaboration tools for your organization
- Network management and monitoring of your own systems and infrastructure
2. Prohibited Activities
The following activities are strictly prohibited on First City Internet’s network and services:
a. Illegal Activity
- Any activity that violates local, state, federal, or international law or regulation
- Transmission, storage, or distribution of child sexual abuse material (CSAM) or any content that exploits minors
- Unauthorized access to computer systems, networks, or data (hacking, cracking, or unauthorized intrusion)
- Intellectual property infringement, including unauthorized distribution of copyrighted materials
b. Network Abuse
- Denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks against any host or network
- Port scanning, vulnerability scanning, or network probing of third-party systems without authorization
- Transmission of malware, spyware, ransomware, viruses, or other malicious code
- Operating open mail relays or participating in email spam campaigns
- IP address spoofing or falsifying packet headers
- Circumventing network security controls, firewalls, or access restrictions
- Actions that degrade the performance or availability of our network or services for other customers
c. Harmful or Abusive Content
- Harassment, threats, or intimidation of any individual or group
- Distribution of content that facilitates violence, terrorism, or hate crimes
- Phishing, social engineering, or impersonation of individuals or organizations
d. Resale and Unauthorized Use
- Reselling or subletting your internet service to third parties without prior written authorization
- Using the service in a manner inconsistent with your service tier or agreement
- Allowing unauthorized parties to use your service connection
3. Network Integrity and Responsible Use
To maintain a reliable network for all customers, you agree to:
- Use bandwidth in a manner consistent with your service plan and not engage in sustained activity that adversely affects other customers
- Maintain reasonable security on your own equipment and network to prevent unauthorized use of the service
- Promptly report any suspected security incidents, network abuse, or policy violations to First City Internet
- Keep contact information current with First City Internet to facilitate prompt communication regarding network issues
4. Colocation and Data Center Customers
Customers using First City Internet’s colocation services are additionally required to:
- Comply with all physical facility access rules and security procedures
- Ensure that colocated equipment does not interfere with the operation of other customers’ equipment
- Maintain equipment within assigned rack space and adhere to power and cooling specifications
- Obtain advance approval for equipment installations or modifications that may affect shared infrastructure
5. Enforcement
First City Internet reserves the right to investigate suspected violations of this AUP. In response to a confirmed or suspected violation, we may take one or more of the following actions, in our sole discretion:
- Issue a written warning
- Temporarily suspend or throttle service
- Permanently terminate service without refund
- Remove or block access to offending content or traffic
- Notify and cooperate with law enforcement authorities
- Pursue civil remedies for damages resulting from the violation
We will make reasonable efforts to notify customers prior to taking action, except where the violation poses an immediate threat to network security, other customers, or requires emergency response.

If you become aware of any activity that violates this AUP or suspect abuse of our network, please report it to us promptly:
7. No Warranty of Monitoring
First City Internet does not routinely monitor customer data transmissions for compliance with this AUP. However, we reserve the right to monitor network traffic for the purpose of network management, security, and investigation of reported violations. This AUP does not create any obligation on the part of First City Internet to monitor or police the content transmitted over our network.
8. Amendments
First City Internet reserves the right to modify this AUP at any time. Changes will be posted to this page with an updated effective date. Continued use of our services after such changes constitutes your acceptance of the revised AUP. We encourage you to review this policy periodically.
